Mission Statement

Provide clients with intellectual property law services based on extensive experience.  Primary services are litigation and counseling in patent-related matters.  Emphasis is on prompt attention to client problems, balanced counseling, reasonable fees, strategic support and assistance, and in litigation, aggressive representation. 
Cost-effective techniques have been developed for litigating complex matters against large opponents.  Through an extensive network of litigation and IP firms excellent litigation resources are available, when called for in large scale lawsuits.  Assistance is also available in all areas of IP including trademarks, copyrights, trade secrets, unfair competition and licensing.

 

The following cases are those that were more challenging in one manner or another.  They represent a variety of intellectual property matters.  Some of these cases are still pending, others have been concluded.  Papers in these cases are available directly from those courts that are connected to PACER and, if not, we can provide a docket sheet and/or the particular document of interest.

Artists v. Leegin

The case was settled for several million dollars in 1996.

Bray v. Regent of the University of New Mexico
Federal District Court, New Mexico

            A domain name dispute.  After the University received a successful award in a dispute resolution proceeding, the trespasser unsuccessfully went to court to seek reversal including theories based on First Amendment rights.  The University client was successful.

CIU Corporation v. American Polysteel
Federal District Court, Montana

            The case was settled favorably to Polysteel in October, 2001.

Containment Solutions Inc. v. Hall Patent Group, et al.
Federal District Court, Northern District of Texas, Dallas Division

After charging some forty companies with patent infringement, the client was sued for a declaratory judgment that the patent was invalid, non-infringed, and unenforceable.  The suit was settled shortly before trial for a monetary sum and the transfer of patents owned by the plaintiff.

Co-Z Development v. Aerocad Corporation
Federal District Court, Middle District of North Carolina

A supplier of plans for home built airplanes sued a copyright infringer; the case involved the unique question of infringement of plans by building an actual plane.  The case was successfully settled.

After a four-week trial against Jones, Day, MIDCO was awarded jury verdict and judgment of $25 Million reversed b the Federal Circuit of Appeals

Park v. CAS Enterprises, Inc. d/b/a Kreg Tool Company
Federal District Court, Southern District of California

Settled after a jury verdict to the client’s satisfaction.

Pro Team, Inc. v. Sandia Plastics, Inc.
Federal District Court, New Mexico

            A design patent infringement case, settled to the satisfaction of the client.

PSC Computer Products, Inc. v. Foxconn International, Inc.
Federal District Court, Central District of California; Federal Circuit Court of Appeals

A patent infringement case against the U.S. subsidiary of Hon Hai Precision Industry Co. Ltd., one of the largest manufacturers of computer components in the world and assembler of Compaq and HP computers.  The case involved a computer heat sink and was lost on a motion for summary judgment of non-infringement under the doctrine of equivalents.  The appeal was unsuccessful.  355 F.3d 1353 (Fed. Cir. 2004)

            Hon Hai in retaliation sued PSC on one of its patents in the same court.  PSC prevailed on a motion for summary judgment based on estoppel.  The case was settled pending appeal.  115 Fed Appx. 74 (Fed. Cir. 2004)

Regents of the University v. Kim
Second Judicial District, New Mexico

            A successful suit to recover the intellectual property rights of the University of New Mexico, specifically, to obtain assignment of a patent application and to shut-down an ex-professor business competing with the University’s licensee.

R.T. Temps, Inc. v. Rapid Temps, Inc.
Federal District Court, Eastern District of Pennsylvania

Defendant’s trademark infringement resulted in Plaintiff’s jury verdict.
